Estt. – Provisional / Adhoc  Promotion, Posting and Transfer in the grade of Senior Tax Assistant  subject to the outcome of SLPs pending in Hon’ble Supreme Court

Consequent to the Review DPC meeting held on 17.06.2009, Shri. M. Joseph Jeyaraj (3758), Tax Assistant, Trichy Excise is promoted to the grade of Senior Tax Assistant in the pay structure PB-2 (9300– 34800) with corresponding Grade pay of Rs.4200/-  provisionally and purely on adhoc basis with effect from 19.05.2008 (i.e., w.e.f. the date of joining of his immediate junior Smt. M. Jayanthi Mala), subject to the outcome of the SLPs filed by the department in the Hon’ble Supreme Court (registered as CC No.5272-5284/2008) and interim directions dated 04.04.2008 of Hon’ble Supreme Court against the judgement of Hon’ble Madras High Court dated 13.4.2007 in W.P.Nos. 8361/2004 & Ors. and of any other cases pending in appropriate forum.  

02.       On promotion, he is nominated to Chennai Central Excise Zone.

03.       His seniority will be fixed below Smt. G. Kavitha (Emp code 3759) and above Smt. M. Jayanthi Mala (Emp code 2911), who were promoted vide this office order no.51/2008 dated 19.05.2008. 

04.       The officer promoted on adhoc basis is not entitled to exercise option for fixation of pay and the promotion does not confer on the officer so promoted any claim for continued officiation in the grade of Senior Tax Assistant  and the period of such service will not count for seniority or as qualifying service for further promotions.   

05.       This is issued with the approval of the Competent Authority.
